eSquirrel’s privacy policy

Like any app and web platform, we process user data to provide our service. We take on this task with great responsibility and make sure that your data is protected in the best possible way.

The Privacy Policy is a formal document in which we explain what information we store about you and how we handle it. These are game rules for using the eSquirrel platform, which we are 100% committed to.

Optionally, this helpful form for printing, which summarizes the points for students and students, serves as an aid to teachers and students. This form is optional. The legal effective consent to the privacy policy is given by each eSquirrel user through the platform (whether Android, iOS or Web) itself.

In summary, this means …

1. General

The eSquirrel GmbH (operator of www.eSquirrel.at (and other domains in their name), the eSquirrel portal portal.eSquirrel.at and the eSquirrel apps on iOS and Android – hereinafter referred to as “eSquirrel”), with headquarters in Guglgasse 6/2/608, 1110 Vienna, tries to do everything in its power to prevent unauthorized access to data of its users. Technical protection measures from the beginning (“privacy by design”) such as SSL encryption, trusted cloud solutions such as Heroku and AWS in the EU should guarantee the highest possible data security.

By registering, the user allows the collection, processing and use of personal data by eSquirrel or by third party service providers in the name and on behalf of eSquirrel based on the following privacy policy. The consent of the user is logged by eSquirrel.

The user has the right at any time to revoke the consent to the use of his data described in detail below within the scope of the statutory provisions. An e-mail to [email protected], in which the user indicates the e-mail address, telephone number or Facebook ID used in the course of the registration, is sufficient for the revocation. After the revocation the user can not use eSquirrel any more or only to a limited extent.

eSquirrel cares about the handling of your data. To use eSquirrel, you must provide some personal information and consent to its processing. You can revoke this consent at any time.

2. Collection, processing and use of personal data

In order to provide eSquirrel with the services described in the General Terms and Conditions (GTC), it is necessary to collect, process and use personal data that the user specifies, especially in the course of the registration process or when completing his profile.

Personal data are individual details about personal or factual circumstances of a specific or identifiable natural person.

In the course of the free registration, the user is asked to provide certain information, without which the registration can not be completed.

The following data is provided by the user during registration:

  • First name (taken over by Facebook from Facebook)
  • Last name (taken over from Facebook on Facebook login)
  • Parent’s name, if required by age for consent to the privacy policy
  • E-mail address or phone number or Facebook ID
  • Password (selected by the user, if not via Facebook login)
  • Primary role in the eSquirrel platform (student, teacher, trainer, miscellaneous)
  • Age at the time of registration
  • Country of residence
  • Device language

Access to eSquirrel takes place via the access data, which consists of the user-specified e-mail address or telephone number and the password defined by it or the Facebook login.

When users log in via e-mail address or phone number, they must verify the e-mail address or phone number by confirming an e-mail or text message. eSquirrel saves the date of the confirmation.

2.1 Who sees my learning progress?

Roles at eSquirrel

eSquirrel has several roles that you can all use with the same account. In each role, you can do different things.

Author. As a writer, you are creating new new courses. These include chapters, quests and questions.

Teacher. As a teacher, you create new classes based on courses. You either created these courses yourself or you use courses that eSquirrel has created for you with the utmost care.

Student. As a student, you’ll be asked questions about the course you either bought in the app itself (these classes are called “Store Class”), or provided by your teacher (these courses are called “normal class”).

Publishing company. As a publisher, you can see the sales generated by your eSquirrel courses and the number of times your course has been loaded.

Types of classes

The visibility of data sent to other members under the eSquirrel profile and learning progress and quiz results depend on the type of class in which you are. We distinguish three types: Normal, Store and Preview.

Normal. In a normal class, the student is connected to a teacher. The classmates are in the same class.
Preview. A preview class is only available to authors who create an eSquirrel course themselves. In this class, only the authors are students. The authors are also the teachers of the Preview class.

Store. This type of class can be bought in the app. There is no teacher hanging on it. All students who have not joined a teacher for this course are in this class.

Data we share

Points. All the nuts you’ve collected in a class added up.
There are nuts from quests that you have repeated many times – that is in a higher level – more worth. Classmates in your Normal class will see your points with your registration name when you’re in the TOP 33% of your class. Only you will see your own position if you are not in the TOP 33%.

Classmates in your store class will see your points with your first name and the first letter of your last name you provided when registering if you are in the TOP 33% of your class. Only you will see your own position if you are not in the TOP 33%.

Learning progress and learning analytics. Your learning progress, quiz results and analysis (eg what you already know best and which questions you still have a hard time with) are what your teachers see when you are in a normal class. Only the operators of the eSquirrel platform see this in a store class. We do not share this information with third parties.
As you progress, your teachers only see you complete quests on time, but not exactly when.

Your progress will be saved to your account. If you are connected to your teacher in a course, he will see your learning progress. He sees if you have completed quests, but not when.

Your classmates only see your score when you are among the TOP 33% of your class. If you are connected to a teacher, your classmates will see your full name. If not, just see your first name and the first letter of your last name.

2.2 Additional technical information

Every access to eSquirrel transmits usage data and, if necessary, saves it in log files. These data are:

  • IP address of the accessing computer
  • Browser type and version
  • Device model, device name, device unique token, and operating system
  • eSquirrel user ID and authentication token
  • Name of the retrieved page
  • Date and time of retrieval
  • Referrer URL
  • Transferred amount of data
  • Status message as to whether the retrieval was successful
  • Log data about the execution of the call

In the so-called login data sets, each time the user logs in to the platform, the following usage data is stored:

  • Date and time of login
  • User ID on eSquirrel
  • authentication token
  • Browser type and version
  • Device model, device name, device unique token, and operating system

To enable push notifications, we periodically submit an identifier to the instance of the application uniquely identified to our servers and to Firebase.

These data are automatically collected for the purpose of providing the eSquirrel service to the user.

When you log in to eSquirrel, additional data will automatically be recorded. For example, when and from which device you have logged in to provide you with the best mobile optimized service.

3. Purpose binding

Personal information is collected primarily to enable users to use eSquirrel securely, smoothly, efficiently and personally. First and foremost, these data are used for:

  • Provision of the user’s desired services Adapting, measuring and improving the performance of eSquirrel and its contents
  • Notification of eSquirrel’s services, news and promotional offers, as permitted by this Privacy Policy.
  • Prevent, detect and resolve any prohibited or illegal activity and enforce eSquirrel’s Terms of Service, resolve disputes and resolve issues.

3.1 Marketing of publishers

For courses created by publishers and offered in the in-app store, you can decide whether your e-mail address may be passed on to the publisher for marketing purposes. If affirmative, it will be made available to the publisher. The permission to be contacted by the publisher can be canceled after receiving the first newsletter via the newsletter itself. The dispatch of the newsletter and the compliance with the respective statutory provisions are the sole responsibility of the publisher.

eSquirrel uses your data only to be able to perform the services described in the terms and conditions.

If you want a publisher to contact you for news, you can explicitly agree to this when you purchase a course in the app. You can revoke the consent directly from the publisher (eg in the newsletter).

4. Disclosure of personal data to third parties

eSquirrel does not sell, barter or otherwise disclose personally identifiable information to third parties for commercial purposes. eSquirrel transfers personal data of users only to third parties, if and to the extent that the user has given his consent to this, or insofar as eSquirrel is obliged to do so as a result of legal regulations or official orders.

eSquirrel is expressly authorized by the users upon registration by accepting the terms and conditions (GTC) to allow the school administration and the school authorities on their request to access the subscriber data. The users will be informed.

Third parties are not external service providers of eSquirrel who provide services on behalf of eSquirrel. These include, for example, host providers, payment providers, debt collection agencies or e-mail or newsletter senders commissioned by eSquirrel for sending e-mails / newsletters from eSquirrel. Under “eSquirrel sub-processors“, you will find a list of all service providers that provide services for eSquirrel under regulated conditions on behalf of eSquirrel.

Use of Google Analytics with anonymization function

We use Google Analytics, a web analysis service of Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043 USA, hereafter “Google”. Google Analytics uses cookies.
The information generated by these cookies, such as the time, location and frequency of your website visit, including your IP address, is transmitted to Google in the United States and stored there.
We use Google Analytics on our website with the addition “_gat._anonymizeIp”. In this case, your IP address will already be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and thus anonymised.
Google will use this information to evaluate your use of our site, to compile reports on website activity for us, and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties if required by law or as far as third parties process this data on behalf of Google.
Google does not claim to link your IP address to other data provided by Google. You can prevent the installation of cookies by setting your browser software accordingly; however, we point out that in this case you may not be able to fully use all functions of our website.

Use of fabric (including Crashlytics) in apps

We use Crashlytics, a web analytics service provided by Google, in our app fabric to improve the app and fix bugs, such as crashes. The data collected will be made available to us anonymously and become the property of Google. We are notified of crashes and see the line of code that caused the crash, the type of device and installed operating system, the amount of free memory and flash memory, and whether the operating system is jailbroken. We use this data to reproduce the error as much as possible and then fix it in a future release.

The data stored by Fabric itself is contained in their terms and conditions  (https://fabric.io/terms).

Of course, eSquirrel will treat your personal information confidentially and will only share it, if at all, with explicit consent. Certain service providers (eSquirrel sub-processors) process the data under regulated conditions on behalf of eSquirrel.

In addition, we use services like Google Analytics that use anonymised data to improve our services.

5. Creation of anonymous and pseudonymous usage profiles for the optimization of services

eSquirrel will conduct and conduct research on the behavior of its users as part of the use of its service, anonymizing and aggregating user data for this purpose. These data are stored within the scope of the EU Data Protection Regulation. The creation of user profiles is for the sole purpose of making eSquirrel’s service more efficient, secure and user-friendly.

eSquirrel reserves the right to aggregate anonymised data in order to analyze it or to pass the anonymised data to trusted sources for analysis.

6. Use of cookies

eSquirrel uses so-called “cookies” for the purpose of performing its services. A cookie is a text file that is either stored temporarily in the computer’s memory (“session cookie”) or stored on the hard disk (“permanent” cookie). Cookies contain e.g. Information about the user’s previous access to the respective server or information about which offers were previously called. Cookies are not used to run programs or download viruses to your computer. Instead, the main purpose of cookies is to provide an offer tailored to the user and to make the use of the service as comfortable as possible.

eSquirrel also uses cookies as part of Google Analytics, see section 4.

The user always has the option to refuse the setting of cookies. This is usually done by choosing the appropriate option in the browser settings or through additional programs. For details, see the help function of the browser used by the user. If the user decides to disable cookies, he can not use eSquirrel in full on the web.

eSquirrel uses cookies for its services – eg to let a user log in to the browser.

7. Information about stored data

The user has the right to request information about the personal data stored at eSquirrel at any time, as well as their origin, the purpose of the storage and the recipient to whom the data is forwarded. This information is free of charge and will be given in writing. The request for information must be accompanied by a copy of the identity card in writing and signed by hand to the following address: [email protected]

You have the right to request information about your stored data.

8. Deletion and correction of data

Upon closure of the account, the associated personal data will be deleted. eSquirrel stores the described data for as long as required by law. It may therefore be that eSquirrel keeps certain data even after the account has been closed. However, this does not lead to restrictions on the right to close an account.

You have the right to close your account and request the deletion of your data.

9. Verification of personal data

To protect against people who misuse eSquirrel’s Internet services, eSquirrel uses randomly automated monitoring tools to randomly analyze activities on the platform and check plausibility of user input, without any legal obligation on eSquirrel. Certain strings or logins from different users, such as those coming from a computer, can lock suspicious activity.

eSquirrel randomly checks the correctness and plausibility of personal data.

10. Current state of the art

The user is aware that data protection in the case of data transmissions on the Internet is not yet comprehensively guaranteed according to the current state of the art. In particular, e-mails do not represent secure communication, as the “reading” of content can not be technically excluded. eSquirrel is not responsible for this, the user himself takes care of the security of the data transmitted by him to the Internet itself.

Data transmission on the Internet, especially e-mails, is not 100% secure. Keep this in mind when sending something to us over the Internet.

11. Disclaimer

eSquirrel has no influence on the compliance with the data protection regulations by the operators of external websites and services of third parties and can not assume any liability for the adherence to the data protection regulations by the operators of linked sites. eSquirrel does not endorse the content of external websites, eSquirrel or users of linked websites or files under any circumstances.

eSquirrel assumes no responsibility for the compliance with the privacy policy of external services to which it links, nor is it responsible for their content.
